OFFICIAL RULES AND REGULATIONS

1. NO PURCHASE NECESSARY TO ENTER OR WIN.  Competition (“Competition”) is open to all legal residents of the United States (excluding residents of Puerto Rico and other U.S. territories and possessions), United Kingdom, France, Spain and Canada (excluding residents of Quebec) who, as of January 1, 2007: (i) have Internet access; (ii) have reached the age of majority in their jurisdiction of residence (and are at least 18 in the U.S. and 19 in Canada) but are not older than 35 years of age; (iii) have not been declared a Grand Prize winner of this competition within the last five (5) years; (iv) are not under exclusive contract(s) with a publisher (as determined by Sponsor) or any other entity which might interfere with their ability to enter into agreements with the Sponsor or any other entity associated with the Contest, as determined by Sponsor in its sole discretion, and (v) are not employees, directors, agents or shareholders (or their immediate families (defined as spouse, parent, child or sibling and each of their respective spouses, regardless of where they reside) or household members (whether or not related) of Turner Classic Movies LP, LLLP (“TCM”), Film Music Publications, Inc. (collectively, the “Sponsors”) or their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, distributors, advertising and promotion agencies or affiliated entities (collectively, with the Sponsors, the "Competition Entities"). Void in Quebec and wherever prohibited by law. By entering the Competition, participants agree to accept and be bound by all terms of these Official Rules and Regulations (“Official Rules”).

2.  HOW TO ENTER: From January 1 – March 31, 2007 (the “Promotional Period”), TCM will be conducting a Competition encouraging participants to create, record and submit an original, previously unrecorded and unreleased original musical composition which would be appropriate for use as a part of a silent film score in association with one of the previously selected clips, described below (the “Project”).  To enter, during the Promotional Period, participants must log on to one of the following TCM websites, located at http://turnerclassicmovies.com/YFCC, tcmonline.co.uk/, www.TCMcinema.fr, or www.canaltcm.com/ (collectively, the “TCM Websites”), view the four (4) featured video clips, select one (1) video clip (approximately sixty-seconds (:60) in length), download the selected video clip to their computer, and compose an original musical composition appropriate for scoring the selected video clip.  Once a participant has composed his/her musical composition, he/she may log on to the TCM Website and follow the instructions on how to upload a recorded performance of his/her original musical composition (the “Demo”) using the technology found on the site. Once the participant accesses the TCM Website, he/she must complete the entire application by entering his/her personal information including his/her first name, last name, e-mail address, and phone number (the “Personal Information”) as well as the title of the submission, and the name of the video clip chosen.  Once this process has been completed, he/she will then be requested to upload his/her Demo as an MP3 file (no WAV, AIFF, or other digital audio data files will be accepted). Once a participant’s Demo is uploaded, he/she will receive a confirmation message on the TCM Website indicating the successful upload and then will automatically be directed to Step 3 to complete the application process. After the final Step 3 is completed he/she will be be sent a confirmation email that they have entered the competition.  If you do not receive a confirmation email within 24 hours of uploading your Demo, please send an email to tcm@turner.com.

A Participant may also submit his/her Competition Application and Demo by mailing a standard compact disc (“CD”) version of the Demo along with the title of his/her Demo and the title of the video clip he/she chose to score along with a completed printout of the Competition Application (which may be accessed at the following address: http://www.turnerclassicmovies-yfcc.com/entry_print.asp), to: Young Film Composers Competition, c/o Turner Classic Movies Marketing Department, 1050 Techwood Drive, Atlanta, Georgia 30318 USA. All mail-in Demos must include music on an audio-format Compact Disk (the “CD”) (no MP3, WAV, AIFF, or other digital audio data files will be accepted).  The audio-format CD must be a standard, full-size CD and must be playable on a standard audio CD player. No “business card” sized or other size/format CD will be accepted.  The music should be included in its entirety on track one (1) of the CD, and no other music or information should be recorded on the CD.  The face of the CD should include the following: (i) the entrant’s name, (ii) the entrant’s phone number and (iii) the video identification clip.  The CD must be packaged in a standard hard plastic CD case.  CDs in paper cases or thin plastic CD sleeves will not be accepted.  Registered mail is recommended. To be eligible, participants must submit both of the following: (i) the completed Competition Application, including the name of his/her score, the confirmation message provided by TCM (if entering online), his/her Personal Information including email address (if any) and (ii) his/her Demo, appropriate for film scoring.  The Demo must be a minimum of fifty-eight seconds (:58) in length and a maximum of sixty-two seconds (:62) in length. To be eligible, (i) each online entry (including the Demo upload and Competition Application) must be received no later than 11:59 p.m. Eastern Time (“ET”) on March 31, 2007 and (ii) the mail-in entries (including the CD and the Competition Application), must be sent via mail and must be postmarked no later than March 31, 2007 and received no later than April 6, 2007, or, for participants from the U.K., Canada, Spain and France, received no later than April 13, 2007. 

All participants selected as Semi-Finalists (as defined below) must be available to participate in the Competition and all related activities (as set forth below) from the time they are declared a Semi-Finalist through December 31, 2007 or he/she may be disqualified. All entries must be submitted in the name of an individual person.  Prize will only be awarded to the person whose name is on a winning entry.  The musical composition must be the original work of a single participant. TCM will require execution of releases drafted to the satisfaction of TCM, verifying that: (a) the musical composition is the original work of a single participant, (b) the Demo is the original work of a single participant; and (c) the participant, if selected as a Finalist (as defined below) or a Winner (as defined below), agrees to be filmed and/or interviewed by telephone or in person should they be requested to do so.  Participant also agrees, if selected as one (1) of the five (5) Finalists to make him/herself available to travel to California for the final round of judging and attendance at the awards ceremony. Failure to execute these releases shall result in disqualification. Group submissions will not be accepted or judged. Each participant is responsible for ensuring that he/she is eligible to enter to the USA and has any necessary visas, passports and other documentation. Competition Entities reserve the right to change the method of submitting Demos and Competition Applications at their sole discretion.  The Competition Entities are not responsible for misdirected, incomplete, lost, late, damaged, illegible or postage due entries, technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions, or other errors or problems of any kind which may limit or affect a person’s ability to participate in the Competition (whether human, mechanical, typographical, printing, electronic, network or otherwise), relating to or in connection with the Competition, including, without limitation, errors which may occur in connection with the administration of the Competition, the processing of entries, the announcement of the prizes or in any Competition-related materials. In the event of sabotage, acts of God, terrorism, computer virus or other events or causes beyond the Sponsors’ control, which corrupt the integrity, administration, security or proper operation of the Competition, Sponsors reserve the right, in their sole discretion, to modify, cancel, or suspend the Competition.  In the event of cancellation, Sponsors reserve the right to award prizes from among all eligible, non-suspect entries received prior to the event requiring such cancellation using the judging procedures outlined herein.  False or deceptive entries or acts will render a participant ineligible.  All entries become the property of the Sponsors and will not be returned.  Limit one (1) entry per person, per email and per household.  In the event that multiple entries are submitted, the last entry received by TCM shall be deemed the final entry for purposes of judging.

3.  HOW TO WIN: Ten (10) semi-finalists (the “Semi-Finalists”) will be selected by qualified judges, utilizing a panel of music and film industry professionals (the “Panel”), on or around April 20, 2007, from all eligible entries received.  Selection of Semi-Finalists will be based equally upon the following criteria: originality, creativity, quality and appropriateness to the video clip chosen by the participant (“Judging Criteria”).  The decisions of the judges will be final and binding.  Potential Semi-Finalists will be notified by telephone or e-mail and by mail within seven (7) days of the judging and will be sent a pre-paid overnight mail envelope.  Each potential Semi-Finalist must meet all requirements set forth herein, including the execution and return of all necessary releases and documents. Noncompliance with these Official Rules will result in disqualification and, at Sponsors’ selection, a runner-up may be notified.  To be eligible for the Grand Prize, each potential Semi-Finalist must submit the following:  (i) a copy of his/her original, written score for the Demo submitted, (ii) a signed affidavit or declaration verifying the originality of his/her musical composition, arrangement, Demo and all related materials, (iii) a signed name and likeness release, and (iv) documents acceptable to TCM verifying that he/she meets all eligibility requirements of these Official Rules (collectively, all such submissions shall be referred to as the “Score Submission Materials”).  Potential Semi-Finalists must return the Score Submission Materials in the pre-paid overnight mail envelope provided to them by TCM.  Each such envelope must be postmarked no later than May 3, 2007 and received no later than May 4, 2007 or, for Semi-Finalists from the U.K., Canada, Spain and France (if any), received no later than May 11, 2007 or place as a Semi-Finalists will be forfeited and, at Sponsors’ discretion, a runner-up may be notified. 

Five (5) finalists (the “Finalists”) will be selected by the Panel on or around May 23, 2007 from all Semi-Finalists whose Score Submission Materials were received by the dates specified above using the Judging Criteria.  On or around May 23, 2007, each of the five (5) Finalists will be sent a different ninety-second (:90) video clip that must be scored (in the same manner used to score the first video clip) for the second round of the Competition (the “Second Round”). Finalists must return their Second Round Score Submission Materials in the pre-paid overnight mail envelope provided by TCM, no later than June 22, 2007, or, for Finalists from the U.K, Canada, Spain, or France (if any), received no later than June 29, 2007. (The submission and return dates for the Second Round are subject to change but Finalists will be provided with reasonable notice if this is the case.).  One (1) grand prize winner, one (1) first prize winner, one (1) second prize winner, one (1) third prize winner and one (1) fourth prize winner (the “Grand Prize Winner,” the “First Prize Winner,” the “Second Prize Winner,” the “Third Prize Winner,” and the “Fourth Prize Winner” shall be collectively referred to as the “Winners”) will be selected by the Panel before August 15, 2007 from among the five (5) Finalists using the Judging Criteria . The decisions of the Panel will be final and binding.   The potential Grand Prize Winner will be notified at an awards ceremony before August 15, 2007, or via telephone, e-mail and/or mail within seven (7) days of the completion of the judging and must meet all requirements set forth in these Official Rules, including the timely execution and return of all necessary releases and documents (if any) or prize may be forfeited and, at Sponsors’ discretion, awarded to a runner-up.  In the event of a tie in any round of judging, an additional “tie-breaking” judge will determine the Semi-Finalist(s), Finalist(s) and/or Winner(s) (as applicable) using the Judging Criteria.  Sponsors reserve the right to select fewer than ten (10) Semi-Finalists, five (5) Finalists and/or not to award all prizes if, in their sole discretion, they do not receive a sufficient number of eligible and qualified entries.

4.PRIZES:

Grand Prize: One (1) Grand Prize Winner will receive: (a) the opportunity to compose a musical score for a silent film entitled “Beau Brummel” (the “Score”), (b) a trip for one (1) to Los Angeles, CA, (c) a cash prize in the amount of Fifteen Thousand U.S. Dollars (U.S. $15,000.00), (d) Mac Pro desktop computer with 4GB of memory, (e) 23" Apple Cinema Display and (f) Logic Pro software. Total approximate monetary value (“AMV”) of Grand Prize: Twenty-One Thousand Eight Hundred Forty-Seven U.S. Dollars (U.S. $21,847.00) based on city and country of departure.  Actual value will vary depending on location of Grand Prize Winner’s residence.  The trip includes the following:  (i) round trip coach class air transportation (or other reasonable transportation as determined by TCM) for one (1) from the international airport in the United States, Canada, Spain, France or the UK nearest the Grand Prize Winner’s residence to Los Angeles, CA, U.S.A., (ii) standard double occupancy hotel accommodations (one (1) room) for seven (7) days/six (6) nights and (iii) ground transportation between the hotel, the Los Angeles airport (or other location as determined by TCM) and the recording facility.  The Grand Prize Winner will be mentored through the process of scoring a silent film by a team of music and film industry professionals and will have the opportunity to have his/her music recorded and synchronized with the silent film “Beau Brummel” for possible exhibition on the TCM network and/or website. TCM has the right to approve all aspects of the production of the Score, including the budget and artistic direction, and Sponsors will pay for the recording and production process.  The Grand Prize Winner must be available to TCM and work in conjunction with TCM until February 1, 2008 to complete work on the Project.

First Prize: One (1) First Prize Winner will receive one (1) MacBook Pro 17” laptop computer with 2 GB of memory and Logic Pro Software, at an AMV of Four Thousand Dollars ($4,000.00).

Second Prize: One (1) Second Prize Winner will receive one (1) MacBook Pro 15” laptop computer with 2.16GHz Core Duo and 1 GB of memory and Logic Pro Software, at an AMV of Three Thousand Five Hundred Dollars ($3,500.00).

Third Prize: One (1) Third Prize Winner will receive one (1) MacBook Pro 15” laptop computer with 2GHz Core Duo and 512 MB of memory and Logic Pro Software, at an AMV of Three Thousand Dollars ($3,000.00).

Fourth Prize: One (1) Fourth Prize Winner will receive one (1) iMac 20” with 2.16 GHz Intel Core Duo and 1 GB of memory and Logic Pro Software, at an AMV of Two Thousand Five Hundred Dollars ($2,500.00).

General Prize Details:  TOTAL AMV OF ALL PRIZES (5 PRIZES):  Thirty-Four Thousand Eight Hundred Forty-Seven U.S. Dollars ($34,847.00).  No substitution or transfer of prizes or cash redemptions permitted by Winners. Sponsors reserve the right to substitute a prize (or portion thereof) of comparable or greater value, at their sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsors. The Grand Prize Winner is responsible for all costs and expenses associated with prize acceptance and use not expressly provided for above including, but not limited to, travel insurance, meals, incidentals, souvenirs, tips, telephone calls or any other expenses incurred during the trip. The Grand Prize Winner must travel on dates required (to be specified by Sponsors) or the prize may be forfeited and, at Sponsors’ discretion, awarded to a runner-up. Winners are solely responsible for ensuring that they have all necessary visas, passports and any other documents or permissions to enter the USA. If a Winner is unable to enter the USA then Sponsors shall be entitled to disqualify Winner and chose an alternate.  Sponsors will not be responsible for obtaining any visa or other travel documents and will not be responsible for assisting winner to gain access to the USA in the event the winner is refused entry.  Winners are responsible for reporting and payment of all taxes (including any applicable income and withholding taxes) (if any) as well as any other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded. All prize details are at Sponsors’ sole discretion. TCM will supervise and approve all aspects of the production, including the budget, and will pay for the recording and production process. By entering this Competition, participants acknowledge and agree that they will grant TCM the copyright in all submitted musical compositions, arrangements, Demos, the Score Submission Materials and all related materials, and if for any reason such grant does not take place in writing, then participants hereby license TCM the perpetual right to use and exploit all such works in any and all media now known or hereinafter developed, without limitation. Additionally, all Winners (including Semi-Finalists and Finalists) must execute any documents necessary to perfect such rights in TCM, including waiving their moral rights to any of the foregoingSPONSORS RESERVE THE RIGHT, IN THEIR SOLE DISCRETION, TO NOT USE OR BROADCAST THE SCORE. 

5.GENERAL RULES AND REGULATIONS:  By entering this Competition, participants grant Competition Entities and their designees the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Competition Entities and all matters related to the Competition in any manner or medium, throughout the world in perpetuity.  Without limiting the foregoing, participants also grant Sponsors the right to forward the Demos and Score Submission Materials to members of the Panel for the purposes of judging the Competition.  Winners shall also make themselves reasonably available for interviews and other promotional activities as requested by Sponsors. Winners will each be required to execute an affidavit or declaration of eligibility, an affidavit or declaration verifying the originality of his/her musical composition, arrangement, Demo, Score Submission Materials and all related materials (if applicable), a liability release, a tax acknowledgment form (if required) and, except where prohibited by law, and a release for the use of their name and likeness, and must return such documents within five (5) business days of date of issuance of notification. Noncompliance within this time period may result in disqualification.  If: (i) any prize or prize notification is returned as undeliverable, (ii) a Winner declines his or her prize, (iii) the Grand Prize Winner is unable to travel on dates specified by Sponsors or is unavailable through February 1, 2008, (iv) a Winner is not permitted or is otherwise unable to enter the USA or (v) a Winner fails to comply with any of these Official Rules, such Winner will be disqualified and the participant with the next highest ranking will be selected as the alternate winner. (The First Prize Winner shall be deemed the alternate Grand Prize Winner if the Grand Prize Winner is determined to be unable to comply with TCM’s schedule/timeline for the creation of the Score). The Competition Entities expressly disclaim any responsibility and participants agree to indemnify and hold harmless the Competition Entities except in respect of UK residents to the extent that any personal injury or death is caused by the Competition Entities’ negligence, from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Competition (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the prizes awarded or the Competition Entities’ use of any of the rights granted herein.

6.  OFFICIAL RULES, WINNERS’ LIST AND ADDITIONAL ENTRY FORMS: For a copy of the Competition Application (available on or about January 1, 2007), Official Rules or the Winners' List (available on or about August 20, 2007), send a self-addressed, stamped envelope (residents of VT, Canada, Spain, the U.K. and France need not include return postage) to the following address by November 1, 2007:  (Please specify “Competition Application,” “Official Rules” or “Winners”) – “2007 Young Film Composers Competition,” c/o TCM Marketing, 1050 Techwood Drive, N.W., Atlanta, GA 30318.
